THERE WERE OVER 60 ATTENDING THE MEETING AT THE MAUI PRINCE HOTEL BALLROOM.

MORRIS ATTA, STEVE MOLMAN, MARSHA WIENERT, LAURA THIELAN AND A NUMBER OF DOCARE OFFICERS FROM MAUI WERE IN ATTENDANCE.

IF YOU SEE A VIOLATION OR A BEACH WEDDING THAT DOES NOT HAVE A PERMIT, TELL THE DLNR AND THEY WILL FOLLOW UP ON IT

FINES ARE UP TO CERTAIN AMOUNTS FOR FIRST SECOND AND THIRD OFFENCES (LAURA DID NOT MENTION THE AMOUNTS OF THE FINES). ALSO CRIMINAL CHARGES MAY BE APPLIED. REPEAT VIOLATIONS MAY PREVENT YOU FROM BEING ABLE TO OBTAIN ANY PERMITS AS ALL.

EVERYONE WHO IS PART OF THE COMMERCIAL ACTIVITY AT THE WEDDING NEEDS TO BE IN POSSESSION OF ALL PAGES OF THE PERMIT.

Q: WHAT ABOUT RAIN?

A: WITH THE NEW ONLINE SYSTEM YOU MAY REQUEST FOR A DIFFERENT BEACH IF IT IS RAINING.

Q: WHAT IF YOU CAN’T ACCESS ONLINE AT THAT TIME?

A: THE DLNR WILL LOOK INTO HAVING THE ONLINE PERMITTING SYSTEM BE ACCESSIBLE WITH YOUR BLACKBERRY.

Q: WHAT IF WE MOVE TO ANOTHER BEACH AND THEN GO BACK TO OUR OFFICE AFTER THE WEDDING TO CHANGE THE PERMIT LOCATION?

A: THIS WILL NOT BE ACCEPTABLE.AND MUST BE DONE BEFORE THE WEDDING TAKES PLACE. MAKE A CALL A FEW HOURS BEFORE THE WEDDING AS TO A DIFFERENT LOCATION AND ACCESS THE ONLINE SYSTEM TO MAKE THE CHANGE.

Q: WHAT IF THE BEACH WE THINK WILL BE NOT RAINING IS ALSO RAINING, CAN WE JUST MOVE TO ANOTHER BEACH UNDER THE HONOR SYSTEM THAT WE HAD OBTAINED A PERMIT FOR ANOTHER BEACH?

A: NO.

Q: CAN YOU JUST TELL DOCARE THAT IF IT’S RAINING AT A NEARBY BEACH AND WE MOVE IT TO ANOTHER NEARBY BEACH NOT TO HASSLE US?

A: NO.

Q: WE HAVE BEEN ASKING FOR YEARS, WHAT ABOUT ISSUING AN ANNUAL PERMIT?

A: THE ONLINE SYSTEM WILL BE LIKE YOU HAVE AN ANNUAL PERMIT SINCE YOU CAN ASK FOR WEDDING PERMITS FOR A WHOLE YEAR (OR AS LONG AS YOUR INSURANCE IS IN EFFECT).

Q: WHEN EXACTLY WILL THE NO PROPS RULE BECOME EFFECTIVE?

A: OCTOBER 15, 2008

Q: WHY CAN SURF SCHOOLS AND KAYAK COMPANIES HAVE THERE STUFF ON THE BEACH?

A: WE ARE NOT PERMITTING SURF SCHOOLS OR KAYAK COMPANIES TO OPERATE ON THE BEACH. IF YOU SEE THEM THEY ARE OPERATING ILLEGALLY.

Q: I KNOW YOU HAVE NOT MADE THE FINAL DESIGNATION AS TO THE RULES AS TO PROPS ON THE BEACH. PLEASE CONSIDER THIS PETITION SIGNED BY OVER 150 WEDDING PROFESSIONALS THROUGHOUT THE ISLANDS WHO ARE AGAINST LIMITING PROPS FOR BEACH WEDDINGS BEFORE YOU MAKE THOSE DESIGNATIONS.

A: ACTUALLY THE RULES ABOUT “STUFF” ON THE BEACH HAS ALWAYS BEEN IN EFFECT.

Q: WHY IN THE SENATE RESOLUTION SR103 DOES IT STATE “THAT THE DEPARTMENT OF LAND AND NATURAL RESOURCES MUST, “PROVIDE OPPORTUNITIES FOR INPUT AND COLLABORATION WITH WEDDING SERVICE PROVIDERS STATEWIDE WHO PROVIDE SERVICES FOR BEACH WEDDINGS DURING THE RULEMAKING PROCESS” YET YOU HAVE NOT CONSIDERED THE OPINIONS OF THE WEDDING SERVICE PROVIDERS?

A: THE SENATE RESOLUTION YOU ARE REFERRING TO IS ONLY A SUGGESTION.

Q: WHY DO THE HOTELS HAVE CHAIRS, UMBRELLAS AND OTHER STUFF ON THE BEACH AND WE ARE NOT ALLOWED TO HAVE EVEN A SIMPLE CAKE TABLE?

A: THE RULES WILL APPLY ACROSS THE BOARD. WE DON’T WANT OUR BEACHES TO LOOK LIKE TIJUANA. WE WANT OUR BEACHES TO BE ENJOYED BY ALL WITHOUT TOO MUCH COMMERCIALIZATION.

Q: WHAT ABOUT THE DINNER FOR TWO ON THE BEACH WILL YOU ALLOW THAT?

A: NO, THAT IS NOT ALLOWED

Q: SINCE THESE DINNERS ARE DONE AT SUNSET AND AT NIGHT WHEN THERE IS NO ONE ON THE BEACH, WOULD YOU CONSIDER ALLOWING IT ON CERTAIN BEACHES?

A: AGAIN NO IT’S NOT ALLOWED.

COMMENT:

WE WERE HOPING FOR AN ANNUAL PERMIT THAT WOULD BE ABOUT $500 FOR AS MANY BEACH WEDDINGS AS WE DO IN A YEAR. WITH THE ONLINE SYSTEM, ASKING FOR EACH PERMIT INDIVIDUALLY, IF WE DO 200 WEDDINGS IN A YEAR, AT THE MINIMUM OF $20 PER EVENT, OUR ANNUAL PERMIT WOULD COST US $4000.


OBSERVATION:

MANY IN THE AUDIENCE WERE TAKING NOTES AT THE MEETING. NONE OF THE DLNR REPRESENTATIVES WERE TAKING NOTES ABOUT WHAT WE SAID. IT IS OBVIOUS THAT THE DLNR IS NOT ASKING OUR OPINION OR INPUT ABOUT THESE NEW RULES, ESPECIALLY IN REGARDS TO THE NO PROPS RULE AND THE ANNUAL PERMIT, RATHER THEY CAME HERE TO TELL US WHAT THE RULES ARE. THEY DID SAY THAT THEY WILL BE PUTTING TOGETHER A WORKING GROUP OF WEDDING PROVIDERS (OF WHICH JILL CARL WILL BE A MEMBER) TO WORK OUT SOME OF THE ISSUES THAT HAVE COME UP. HOPEFULLY WE CAN USE THIS WORKING GROUP TO GIVE US AT LEAST SOME LEEWAY WITH REGARDS TO SOME PROPS ON THE BEACH AND/OR PROPS (INCLUDING CHAIRS, ARCHWAY, ETC.) AT SELECTED BEACHES.
